By using Bazu! you agree to these Terms. Please read them carefully.

Welcome to Bazu!, a fitness-tracking and strength-training application provided by Bazu Fitness LLC (“Bazu!”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of:

• Bazu! Workout App (iOS)
• getbazu.com and related websites
• Any other services, features, or content provided by Bazu Fitness LLC

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Bazu!.

1. Eligibility

To use Bazu!, you must:

• Be at least 16 years old
• Have the legal authority to enter into these Terms
• Agree to comply with all local and international laws

If you are under 16, you are not permitted to use the Service.

2. Your Account

You may use certain features of Bazu! as a guest without creating an account. However, to save your workout data, sync across devices, and access all features, you must create an account using:

• Apple Sign-In
• Google Sign-In
• Email and password

Guest users: Workouts logged without an account are stored locally on your device. To permanently save this data, you will be prompted to create an account. If you do not create an account, locally stored data may be lost if you delete the app or change devices.

Account holders agree to:

• Provide accurate information
• Keep your login credentials secure
• Not share your account with others
• Notify us immediately if you suspect unauthorized access

We may suspend or terminate accounts that violate these Terms.

3. Use of the Service

You may use Bazu! only for personal, non-commercial fitness tracking.

You may not:

• Reverse engineer, modify, or copy app code
• Attempt to circumvent security or access controls
• Exploit the app for unintended purposes
• Use bots, automation, or scraping tools
• Upload harmful, unlawful, or offensive content
• Interfere with or disrupt Bazu! servers or infrastructure

We reserve the right to remove content or restrict accounts engaging in misuse.

4. Health & Safety Disclaimer

Bazu! provides fitness tracking and insights, but does not provide medical, professional health, or personal training advice.

Algorithmic Recommendations: Bazu! may suggest weight increases, rep targets, or progression adjustments based on your logged workout history. These suggestions are generated by automated algorithms analyzing your past performance data. They are not personalized medical or training advice and do not account for your individual physical condition, injuries, limitations, or fitness level beyond what you have logged.

You are solely responsible for:

• Determining whether any suggested weight, rep count, or exercise is appropriate for you
• Using proper form and technique
• Listening to your body and stopping if you experience pain or discomfort
• Consulting qualified professionals (physicians, certified trainers, physical therapists) before starting or modifying any exercise program

Assumption of Risk: By using Bazu!, you acknowledge that strength training and exercise involve inherent risks of injury. You voluntarily assume all risks associated with your use of the app and any exercises you perform, whether or not suggested by the app.

Bazu! is not liable for:

• Injuries, health conditions, or damages resulting from exercise activities you perform
• Your decision to follow, modify, or ignore any app-generated suggestions
• Equipment failure, improper form, or environmental conditions during your workouts

If you experience pain, dizziness, chest discomfort, shortness of breath, or any medical concerns, stop exercising immediately and seek professional medical care.

5. Apple HealthKit

Bazu! may offer optional integration with Apple HealthKit in future updates. If and when this feature becomes available:

• You may choose to allow Bazu! to read health metrics from and write workout data to Apple Health
• You will control these permissions through your device settings at all times
• HealthKit data will never be used for marketing or advertising
• HealthKit data will not be shared with third parties except as required to provide the Service

This section will apply only when HealthKit integration is available in the app. We will notify you when this feature launches.

6. User-Generated Content

You may upload or create content such as:

• Profile photos
• Workout notes
• Personal goals
• Custom routines

You retain ownership of your content, but grant Bazu! a non-exclusive, worldwide, royalty-free license to store it, display it within the app, and use it to provide and improve the Service. We do not sell or commercialize user-generated content.

You must not upload:

• Copyrighted content you do not own
• Inappropriate, harmful, or illegal material

We may remove content at our discretion.

7. Subscription & Payments

Bazu! may offer premium features ("Bazu! Pro") through in-app purchases or subscriptions in future updates. If and when premium features become available:

• All payments will be processed exclusively through the Apple App Store
• Prices, terms, and billing cycles will be clearly displayed before any purchase
• Subscriptions auto-renew unless you cancel through your Apple App Store account settings before the renewal date
• Bazu! does not directly handle, process, or store your payment information

Refunds: All refund requests must be made directly through Apple. Visit https://support.apple.com/en-us/HT204084 or contact Apple Support.

Free Tier: Core workout logging features are available without a subscription. Specific features included in free vs. premium tiers will be clearly indicated in the app.

This section will apply when in-app purchases or subscriptions become available.

8. Intellectual Property Rights

All rights in the Bazu! app, branding, logos, design, workflows, algorithms, UI components, software, databases, analytics, and website content belong to Bazu Fitness LLC.

You may not copy, modify, or distribute any part of the Service without permission.

9. Privacy

Your use of Bazu! is governed by our Privacy Policy: https://getbazu.com/privacy-policy

The Privacy Policy explains what data we collect, how we use it, and how we protect it.

10. Termination

We may suspend or terminate access to the Service if:

• You violate these Terms
• Your account is inactive for an extended period
• We detect fraudulent or harmful behavior
• Required by law or security concerns

You may delete your account at any time through the app or by contacting support@getbazu.com.

Upon deletion, workout data and personal information are permanently deleted; aggregated or anonymized analytics may be retained.

11. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee:

• Error-free operation
• Data accuracy
• Continuous availability
• Compatibility with all devices
• Fitness or health outcomes

Use of Bazu! is at your own risk.

12. Limitation of Liability

To the fullest extent permitted by law:

• Bazu Fitness LLC is not liable for indirect, incidental, or consequential damages
• This includes lost profits, data loss, injuries, or fitness outcomes
• Our total liability for any claim shall not exceed $50 USD

Some jurisdictions do not allow exclusions, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Bazu Fitness LLC and its affiliates from any claims, damages, or losses arising out of your use of the Service, your violation of these Terms, or your violation of others’ rights.

14. Third-Party Services

Bazu! uses third-party services to operate, including:

• Firebase by Google (authentication, database, analytics, crash reporting, push notifications)
• RevenueCat (subscription management, when available)
• Web hosting and security services

Future integrations may include Apple HealthKit and other services. We will update this section when new integrations are added.

These third-party services have their own terms and privacy policies. We are not responsible for their terms, policies, practices, or service outages. Your use of Bazu! constitutes acceptance that certain data will be processed by these providers as described in our Privacy Policy.

15. Changes to These Terms

We may update these Terms periodically. When changes are material, we will notify users via:

• In-app notice
• Email (if applicable)
• Website announcement

Continued use of Bazu! after changes means you accept the updated Terms.

By creating an account or using Bazu!, you consent to receive electronic communications from us, including:

• Product announcements and feature updates (you may opt out of these)

You agree that all agreements, notices, and communications we provide electronically satisfy any legal requirement that such communications be in writing.

To opt out of non-essential communications, use the unsubscribe link in any email or contact support@getbazu.com.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Bazu Fitness LLC regarding your use of the Service. These Terms supersede any prior agreements or communications regarding the Service.
